These terms are an agreement between you and Start Bigger LLC, a limited liability company registered in the State of New Mexico, USA, with its registered address at 1209 Mountain Road PL NE, STE N, Albuquerque, NM 87110, USA (“we”, “us” or “Start Bigger”). By using startbigger.com, the client area at sis.startbigger.com, or any of our services, you agree to these terms and to the policies linked on this page.
1. Services
We provide three services: web hosting on shared servers with cPanel, domain registration and renewal through an ICANN-accredited registrar, and the “Managed Site” service, where we build a WordPress website and manage its hosting and updates. The specifications and price of each plan are published on the plans page, which forms part of these terms.
2. Eligibility and your account
- You must be at least 18 years old and provide accurate, complete information, and keep it up to date.
- You are responsible for keeping your passwords confidential, for all activity in your account, and for the content and software you or your users upload.
- We may refuse or cancel any order, in particular where we suspect fraud or inaccurate information, and will refund any amount paid for services not provided.
3. Prices, payment and automatic renewal
- Plans are billed for 1, 2 or 3 years in advance. Prices are shown in Jordanian dinars and US dollars; card payments are processed by Stripe and charged in US dollars.
- Services renew automatically at the end of each term at the same price listed at the time of purchase, unless you cancel before the renewal date. Promotional discounts apply to the first payment only, as set out in the Promotions Terms.
- If you save a card in your account, you authorise us to charge the renewal amount to it on the due date.
- Refunds are covered by the Refund Policy, and cancellation and reminders by the Cancellation & Renewal Policy.
- If we change the price of a plan for existing customers, we will email you at least 30 days before your renewal, and you may cancel before then.
4. Acceptable use and resources
Your use is subject to the Acceptable Use Policy. Each account runs within resource limits on a shared server (up to 2 CPU cores and 2 GB of memory, plus file and email limits), and we may restrict an account that affects the stability or security of the server.
5. Suspension and termination
- We may suspend a service for non-payment, for a breach of these terms or the Acceptable Use Policy, or for a security risk. We will warn you before suspending unless the risk is urgent.
- You may terminate a service at any time from the client area. On termination, the account’s files, databases and email are deleted after the period stated in the Cancellation Policy, so please download your copy before then.
6. Elementor Pro
Websites we build are built and managed with Elementor Pro activated from the Start Bigger agency account, for as long as your subscription is active. This is not a licence sold or transferred to you, and we do not hand over the licence key. When your subscription is cancelled or expires, we will notify you and deactivate Elementor Pro on your site 14 days after the notice. Your site content remains yours, and you may activate your own licence or move to another tool.
7. Domains
Domain registrations are also governed by the registrar’s registration agreement and ICANN policies, and the domain is registered in your name. Details are in the Domain Registration & Registrant Rights policy.
8. Content and ownership
You keep ownership of your content. You grant us only the permissions needed to host it, back it up and display it in order to provide the service. Start Bigger’s designs, tools and marks remain ours or our licensors’.
9. US sanctions and export controls
As a US company, we comply with US sanctions and export control laws, including the regulations of the Office of Foreign Assets Control (OFAC). We do not provide services to any person or entity on US sanctions lists, to residents of countries or regions subject to comprehensive US sanctions, or for any use prohibited by these laws. We may suspend any account in breach of this section, without an obligation to refund where the law prevents it.
10. Availability and backups
We work to keep the service available and aim for 99.9% monthly availability, but this is a target, not a guarantee backed by service credits. We take daily backups as described in the Backup Policy; you remain responsible for keeping your own copy of important data.
11. Limitation of liability
The services are provided “as is” to the extent permitted by law. We are not liable for indirect or consequential damages, such as loss of profits, data or goodwill. In all cases, our total liability for any claim is limited to the amount you paid us for the service concerned in the twelve months before the claim.
12. Indemnity
You agree to indemnify us against any third-party claim arising from your content or from your use of the service in breach of these terms or the law.
13. Governing law and disputes
These terms are governed by the laws of the State of New Mexico and the federal laws of the United States. Before any legal action, we both agree to try to resolve a dispute informally by contacting us at support@startbigger.com for 30 days. If it is not resolved, the courts of the State of New Mexico have jurisdiction.
14. Changes to these terms
We may update these terms and will publish the new date at the top of this page. We will email you about any material change 30 days before it takes effect. Continuing to use the service after that means you accept the change.
